Terms of Service

By accessing or using Real Market Labs (“we,” “us,” “our”) services, website, software, and related resources (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, you may not use the Services.

2. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting. Your continued use after changes are posted constitutes acceptance of the new Terms.

3. Description of Services

We provide real-world product and market validation, including ad campaign management, prospect interviews (e.g. via WhatsApp), data collection, analysis, and reporting. Specific deliverables, timelines, and fees are set forth in individual engagement agreements.

4. Fees & Payment

All fees are stated in USD and due in advance of each engagement cycle. We accept credit card, ACH, or other methods as agreed. Unless otherwise specified, all payments are non-refundable.

5. User Obligations

You agree to:

• Provide accurate, current information;
• Cooperate in scheduling interviews and providing feedback;
• Maintain confidentiality of any login credentials;
• Use the Services only for lawful purposes.

6. Intellectual Property

All content, materials, trademarks, logos, and software on the Services are owned by Real Market Labs or its licensors and are protected by copyright, trademark, and other laws. Your use of the Services does not grant you any ownership rights.

7. Confidentiality

“Confidential Information” means non-public business information disclosed by one party to the other. Both parties agree to keep confidential all such information and use it only to perform their obligations under these Terms.

8. Privacy

Our Privacy Policy explains how we collect, use, and protect your personal data. By using the Services you consent to that collection and use.

9. Third-Party Services

The Services may integrate or link to third-party tools (e.g., ad platforms, messaging apps). We are not responsible for their content or performance. Your use of such tools is subject to the third party’s terms and policies.

10. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REAL MARKET LABS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE TOTAL FEES PAID BY YOU IN THE PRIOR SIX (6) MONTHS.

12. Indemnification

You agree to indemnify, defend, and hold harmless Real Market Labs and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of or relating to:

• Your breach of these Terms;
• Your use or misuse of the Services;
• Your violation of any law or third-party rights.

13. Term & Termination

These Terms remain in effect until terminated. We may suspend or terminate your access at any time for violation of these Terms or for any other reason. Upon termination, any fees owed remain due and you must cease all use of the Services.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws principles. Any dispute shall be brought exclusively in the state or federal courts located in Orange County, Florida.
